FG Slams Amended Charges Against Nnamdi Kanu

 


The office of the Attorney-General of the Federation and Minister of Justice has on behalf of the federal government, filed a seven-count amended charge against the leader of the proscribed Indigenous People of Biafra (IPOB), Nnamdi Kanu.

Naija News understands the charges are based on treasonable felony and acts of terrorism.

The amended charges against the embattled IPOB leader come a few days before the re-commencement of Kanu’s trial on Thursday before Justice Binta Nyako of the Federal High Court in Abuja.

As earlier reported by Naija News, a trial notice has been issued by the Federal High Court in Abuja on the leader of the Indigenous People of Biafra, Nnamdi Kanu in the treasonable felony charges filed by the Federal Government.

The trial notice entitled “Federal Republic of Nigeria Versus Nnamdi Kanu” was marked FHC/ABJ/CR/383/15 and served on Kanu’s lawyer, Mr. Ifeanyi Ejiofor, and that of the Federal Government Mr. Shuaib Labaran.

The trial notice was issued following the resumption of the charges levelled against the IPOB leader.

The court in the notice instructed the lawyers involved in the case things to put in place ahead of the proceeding.

Meanwhile, the Federal Government has been asked to dialogue with the proscribed Indigenous People of Biafra (IPOB) and its leader, Nnamdi Kanu, to stop the killings and violence taking place in the South East.

According to the apex Igbo socio-cultural organization, Ohanaeze Ndigbo Worldwide, the only way to stop the insecurity in the region is for the government to sit down with the pro-Biafra agitators.

In a statement on Monday by its spokesman, Alex Ogbonnia, Ohanaeze Ndigbo asked President Muhammadu Buhari to negotiate with IPOB just as his administration and his predecessors did with herdsmen and Niger Delta militants.

The group added that all South-East leaders are set to meet with the federal government to discuss the numerous challenges confronting Ndigbo and Nigeria in general, adding that dialogue is a panacea to peace.

It urged the government to stop the “jackboot approach” to the IPOB agitation, saying that the military approach would rather aggravate the precarious situation.

Ohanaeze, however, urged President Buhari to ensure that the Department of State Service (DSS) produce Kanu in court on Thursday, October 21, 2021, during his ongoing trial.

The Full List Of Amended Charges FG Brought Against Nnamdi Kanu

 


Ahead of Thursday’s court session, the full list of the amended charges filed against Nnamdi Kanu by the federal government of Nigeria has been obtained.

Kanu, the leader of the proscribed Indigenous People of Biafra (IPOB) is scheduled to appear before Justice Binta Nyako of the Federal High Court in Abuja.

The office of the Attorney-General of the Federation and Minister of Justice has on behalf of the federal government, filed a seven-count amended charge against the leader of the proscribed Indigenous People of Biafra (IPOB), Nnamdi Kanu.

 

The charges border on treasonable felony and acts of terrorism.

Below are the charges.

Count one:

That you Nnamdi Kanu, male adult of Afaraukwu lbeku Umahia North Local Government Area of Abia State being the leader of the Indigenous People of Biafra (IPOB) on diverse dates in 2014 and 2015 in London, United Kingdom, did broadcast on Radio Biafra monitored in Enugu and other areas within the jurisdiction of this Honourable Court, preparations made by you and others now at large for states in the South-East and South-South zones and other communities in Kogi and Benue States to secede from the Federal Republic of Nigeria with a view to constituting same into the Republic of Biafra and you thereby committed an offence punishable under Section 41(c) of the Criminal Code Act, CAP. C77, Laws of the Federation of Nigeria, 2004.

Count two

That you Nnamdi Kanu, male, adult, of Afaraukwu Ibeku, Umuahia North Local Government Area of Abia State, on or about the 28th April, 2015 in London, United Kingdom did broadcast on Radio Biafra monitored in Enugu, Enugu State and other parts of Nigeria within the jurisdiction of this Honourable Court, referred to Major General Muhammadu Buhari, GCON, the President and Commander-in-Chief of the Armed Forces of the Federal Republic of Nigeria as a paedophile, a terrorist, an idiot and an embodiment of evil, knowing same to be false and you thereby committed an offence contrary to Section 375 of the Criminal Code Act, Cap C. 77, Laws of the Federation of Nigeria 2004.

Count Three

That you Nnamdi Kanu, male adult of Afaraukwu lbeku Umahia North Local Government Area of Abia State between the month of March and April 2015 imported into Nigeria and kept in Ubulusiuzor in Ihiala Local Government Area of Anambra state within the jurisdiction of this Honourable Court, a Radio transmitter known as TRAM 50L concealed in a container of used household which you declared as used household items and you thereby committed an offence contrary to Section 47 (2) of the Criminal Code of Act, Cap C45, Laws of the Federation of Nigeria, 2004.

 

Count four

That you Nnamdi Kanu, male, adult. of Afaraukwu iIbeku, Umuahia North Local Government Area of Abia State in London, United Kingdom between 2018 and 2021 Radio Biafra monitored in Enugu, Enugu State and FCT, Abuja within the jurisdiction of this Honourable Court, professed to be a member of Indigenous People of Biafra (IPOB), a proscribed organisation in Nigeria and you thereby committed an offence punishable under Section 16 Terrorism Prevention Amendment Act, 2013.

Count five

That you Nnamdi Kanu, male, adult, of Afaraukwu Ibeku, Umuahia North Local Government Area of Abia State on the 22nd of April, 2021 in London, United Kingdom on Radio Biafra monitored in Enugu, Enugu State and other parts of Nigeria within the jurisdiction of this Honourable Court did an act of terrorism in that you incite the other members (followers) of the Indigenous People of Biafra (IPOB}, a proscribed organisation in Nigeria, to look for security personnel, their family members through a Radio Biafra on 102.1FM monitored through the IPOB Community Radio and you thereby committed an offence contrary to and punishable under Section 1 (2) (h) of the Terrorism Prevention Amendment Act.

Count six

That you Nnamdi Kanu, male, adult, of Afaraukwu Ibeku, Umuahia North Local Government Area of Abia Stale on the 16th of May, 2021, in London, United Kingdom within the jurisdiction of this Honourable Court did commit an act in furtherance of an act of terrorism by making a broadcast that “In 2 weeks’ time, what will happen will shake the world, people will die, the whole world will stand still, mark my word” and you thereby committed an offence contrary to and punishable under Section 1 (2) (b) of the Terrorism Prevention Amendment Act, 2013.

Count seven

That you Nnamdi Kanu, male, adult, of Afaraukwu Ibeku, Umuahia North Local Government Area of Abia State on the 31st of May, 2021, in London, United Kingdom within the jurisdiction of this Honourable Court did an act in furtherance of an act of terrorism by issuing a deadly threat that anyone who flouted your sit-at-home order should “write his/her will,” as a result banks, schools, markets, shopping malls, fuel stations were not opened for businesses and vehicular movements grounded and you thereby committed an offence contrary to and punishable under Section 1 (2) (b) of the Terrorism Prevention Amendment Act, 2013.

Meanwhile, the legal counsels to the embattled leader of the Indigenous People of Biafra (IPOB) Nnamdi Kanu have promised to serve the federal government legal fireworks as the trial of the Biafra agitator resumes.

 

Kanu’s lead counsel, Ifeanyi Ejiofor sounded the note of readiness while reacting to the amended charges slammed against his client by the federal government.

He spoke in a statement on Monday night after he and his colleague, Alloy Ejimakor visited the IPOB leader in custody and assured that they were ready to meet the government in court.

Nnamdi Kanu’ll ‘force’ Igbo President to declare Biafra – Dokpesi




 

Raymond Dokpesi, the founder of DAAR Communications, has disclosed how the agitation for Biafra by Nnamdi Kanu, leader of the Indigenous People of

 Biafra, IPOB, has affected the chances of the southeast producing a Nigerian president.

Dokpesi disclosed that some Nigerians believe that Kanu would force a Nigerian president of Igbo extraction to declare Biafra.

He said the IPOB leader may use militant tactics to blackmail and force an Igbo President to declare South East independence.

He stressed that Kanu and IPOB have complicated the agitation of the Southeast to produce a Nigerian president.

Dokpesi, in a statement he issued on Monday, stressed his belief in a united and indivisible Nigeria.

The statement reads partly: “The emergence of IPOB and its influence across the South East has complicated and undermined the agitation for patriotic Nigerians of Igbo extraction to lead this nation as far as the 2023 election is concerned.

“If nobody has told Ohaneze Ndigbo before, the concern today from some other regions is that if Nnamdi Kanu plays the role of Aguiyi Ironsi in leading a militant revolt against constitutional government in the southeast under Igbo presidency, the president will be pressured by his base to facilitate the UN processes for the South East to call for independence from Nigeria.

“Thus an Igbo President may be compromised in protecting the political and geographic boundaries of Nigeria whilst Nigeria remains under the threat of IPOB’s secessionist activities.”

Prior to his rearrest, Kanu had led the agitation for the actualization of Biafra.

While in the United Kingdom, UK, Kanu was pushing for the actualization of Biafra by engaging those he could across the world.

He used Twitter and Radio Biafra more in spreading his Biafra messages across Nigeria and the world.

Biafra Group Vows To Close Nigeria/Cameroon Borders For Days Ahead Of Nnamdi Kanu's Trial

 


This comes ahead of Thursday, October 21 when Kanu's trial will resume.

pro-Biafra group, the Biafra Nations League (BNL) has ordered the closure of borders between Nigeria and Southern Cameroon, in solidarity with the embattled leader of the Indigenous People of Biafra (IPOB), Nnamdi Kanu. 

This comes ahead of Thursday, October 21 when Kanu's trial will resume. 

The group in a statement by its National Leader, Princewill Richards said the shutdown will begin from Tuesday, October 19 and last till Friday 22. 

It is expected to affect the borders between Cameroon and Cross River, Akwa Ibom and Bakassi Peninsula.

It ordered its members to shut down the borders and the Gulf of Guinea, preventing the movement of vessels to Nigeria through the Bakassi Peninsula for four days from 19th October to 22nd October in solidarity with the court trial of Kanu.

Richards who revealed that the BNL talked with some IPOB hierarchy, said the decision was reached after an emergency meeting at Abana, the former headquarters of Bakassi Peninsula, Vanguard reports. 

He further disclosed that BNL is making moves to shut down oil firms in the Peninsula that are paying taxes to Nigeria and Cameroonian governments as against the directives issued to the companies to stop remitting taxes to the two governments. 

It condemned the position of both countries on secession, describing it as unacceptable.

Suspected BNL members had on a few occasions destroyed properties belonging to the Cameroonian authorities, including bringing down Cameroon’s national flag in the region some weeks ago.

According to reports in Cameroon, the BNL militias took over control of the territory, which the government of Cameroon denied.

Richards however said there would be no room for peace as long as both Nigerian and Cameroonian governments are in an alliance against Biafra.

“We warn that should the federal government continue to use the military against the Biafra agitators in the South East, we will shut down all borders. It is not a threat, but a warning. We’ve given an earlier warning so that nobody will blame us for our actions,” Richards said.

BNL admitted that it was responsible for cross border activities and smuggling to Southern Cameroon, which has helped the Ambazonia separatists in the fight against Cameroon.

He said all the groups in Southern Cameroon rely on their assistance despite the denial of the alliance by some of their leaders.

BNL claims it has direct links with the separatists in Southern Cameroon. Members of the group are mainly from border towns and the Bakassi Peninsula

Free Mazi Nnamdi Kanu Initiative Clarifies Reliefs Sought By Biafra Leader, Nnamdi Kanu In Lawsuit Against Buhari Government

 


The suit seeks to enforce Kanu’s right to life and dignity, liberty, fair hearing, and freedom from arbitrary arrest, detention and unlawful expulsion.

An initiative called #FreeMaziNnamdiKanu has clarified the reliefs sought in the lawsuit filed by Aloy Ejimakor, one of the counsel for Nnamdi Kanu, the detained leader of the Indigenous People of Biafra (IPOB), on behalf of the separatist leader before the Abia State High Court. 

On September 7, 2021, Ejimakor filed a suit before a state High Court to press for Kanu’s release to get adequate medical treatments, among other rights entitled to him. 

The suit seeks to enforce Kanu’s right to life and dignity, liberty, fair hearing, and freedom from arbitrary arrest, detention and unlawful expulsion. 

While Kanu is the applicant, there are eight respondents: Federal Republic of Nigeria; Attorney-General of the Federation; Chief of Army Staff; Brigade Commander, 14 Brigade, Nigerian Army, Ohafia, Abia State; Inspector-General of Police; Commissioner for Police, Abia State; Director-General, State Security Service (SSS) and Abia State Director, State Security Service. 

The clarification comes amid negative campaigns against the suit which is allegedly being sponsored by Kanu's enemies. 

A statement sent to SaharaReporters by the #FreeMaziNnamdiKanu initiative reads: “For the avoidance of any doubt, the Suit filed by Barr. Aloy Ejimakor on behalf of Mazi Nnamdi Kanu at the High Court of Abia State is requesting the following:

“A declaration that the military invasion of Mazi Nnamdi Kanu’s home in Abia State in September 2017 by the Nigerian government is illegal, unlawful, unconstitutional and amount to infringement of his fundamental rights to life, the dignity of his person, his personal liberty and fair hearing as guaranteed under the provisions of the Nigerian Constitution and the African Charter on Human and People’s Rights.

“A declaration that the arrest of Mazi Nnamdi Kanu in Kenya by agents of the Nigerian government without due process of law is arbitrary, illegal, unlawful, unconstitutional and amounts to infringement of his fundamental rights against arbitrary arrest, to his personal liberty and to fair hearing as guaranteed under the Nigerian Constitution and the African Charter on Human and People’s Rights.

“A declaration that the torture and detention of Mazi Nnamdi Kanu in Kenya by agents of the Nigerian government is illegal, unlawful, unconstitutional and amounts to infringement of his fundamental rights against torture and to fair hearing, as guaranteed under the Nigerian Constitution and the African Charter on Human and People’s Rights.

“A declaration that the expulsion of Mazi Nnamdi Kanu from Kenya to Nigeria by the Nigerian government and his consequent detention and planned prosecution in Charge No: FHC/ABJ/CR/383/2015 (Federal Republic of Nigeria v. Nnamdi Kanu) is illegal, unlawful, unconstitutional and amount to infringement of his fundamental rights against unlawful expulsion and detention, and to fair hearing, as guaranteed under the Nigerian Constitution and the African Charter on Human and People’s Rights.

“An order of injunction restraining the Nigerian government from taking any further step in the prosecution of Mazi Nnamdi Kanu in Charge No: FHC/ABJ/CR/383/2015 (Federal Republic of Nigeria v. Nnamdi Kanu) pursuant to his unlawful his expulsion from Kenya to Nigeria.

“An order mandating and compelling the Nigerian government to forthwith release Mazi Nnamdi Kanu from detention and to restore him to his liberty, same being his state of being as of 19th June, 2021; and to thereupon repatriate him to Britain, his country of domicile and citizenship.

“An order mandating and compelling the Nigerian government to issue an official Letter of Apology to Mazi Nnamdi Kanu for the infringement of his fundamental rights and publication of said Letter of Apology in three (3) national dailies and for such order or further order(s) as the Court may deem fit to make in the circumstances of this Suit.”
